Cross-border bankruptcy claims and recovery for a multinational travel group

Anonymised case · Professional reference

Background and challenges

A multinational travel group encountered financial distress following an industry shock and entered restructuring proceedings. Its affiliates operated across Canada, the United States and other jurisdictions. Creditors faced complex claims filings, procedural coordination and uncertain distributions across jurisdictions, with a risk of losing their claims or receiving substantially reduced recoveries.

Approach and implementation

Working with its Canadian office, the project team reviewed five bankruptcy claim matters and related disputes across three Canadian provinces and two US states. It verified ownership of each claim and supporting documents, completed the required filings, monitored restructuring proceedings and took timely legal action on claim recognition, objections and related disputes to protect creditors' interests.

Outcomes

Following years of sustained work, the team helped creditors file and assert their claims in multiple jurisdictions, obtain recognition and distributions in the bankruptcy proceedings, and address the challenges of cross-border debt recovery.

Lessons for international cooperation and governance

Cross-border bankruptcy claims and distributions depend heavily on procedural coordination and information sharing. This case offers a replicable approach to international debt recovery, enforcement and judicial assistance, and practical experience for the Alliance's cross-border dispute resolution and asset recovery work.
